WELCOME TO ESTELLE LUXE

These Terms and Conditions ("Terms") govern your access to and use of the Estelle Luxe website ("Site") and the purchase of products offered under the Estelle Luxe brand. The Site is owned and operated by Astrik Labz, the legal entity, operating under the brand name “Estelle Luxe” (hereinafter referred to as “Estelle Luxe”, “we”, “us”, or “our”).

By accessing or using the Site, you acknowledge that you have read, understood, and agreed to be bound by these Terms, without limitation or qualification. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE SITE.

1. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to make a purchase on the Site. If you are under such age, you may browse the Site but may not place an order.

2. Use of Products

All products and services available on the Site, including any samples, are intended for personal use only. You shall not sell, resell, distribute, or commercially exploit any products purchased from Estelle Luxe. We reserve the right, with or without notice, to cancel or limit quantities of any order that we believe may violate these Terms.

3. Product Information & Accuracy

We strive to display and describe our demi-fine jewellery products as accurately as possible. However, Estelle Luxe does not warrant that product descriptions, images, colors, pricing, or other content on the Site are accurate, complete, reliable, current, or error-free.

The Site may contain typographical errors or inaccuracies, including relating to pricing or availability. Estelle Luxe reserves the right to correct any errors, inaccuracies, or omissions and to update information at any time without prior notice, including after an order has been submitted. Orders placed based on incorrect pricing or availability may be canceled at our discretion.

4. Intellectual Property Rights

All content on the Site, including but not limited to trademarks, logos, designs, text, graphics, images, videos, audio, software, and the overall look and feel of the Site (collectively, the “Content”), is the exclusive property of Astrik Labz, operating under the brand name Estelle Luxe, or its licensors, and is protected under Indian and international intellectual property laws.

You may not reproduce, copy, distribute, sell, modify, create derivative works from, or otherwise exploit any Content without prior written consent from Estelle Luxe. Unauthorized use of the Content will result in termination of any limited licenses granted and may attract legal action.

You are granted a limited, revocable, non-transferable, and non-exclusive license to link to the home page of the Site for personal, non-commercial purposes only, subject to compliance with these Terms.

5. User Submissions & Content

Any feedback, suggestions, ideas, images, videos, reviews, or other content you submit to Estelle Luxe (“Submissions”) shall be deemed non-confidential and non-proprietary. By submitting content, you grant Estelle Luxe a worldwide, royalty-free, perpetual, irrevocable, transferable license to use, reproduce, modify, publish, display, and distribute such Submissions for business, marketing, or promotional purposes.

You represent that you own or control all rights to your Submissions and that such content does not violate any law or third-party rights.

When you tag Estelle Luxe or its products on social media platforms, you grant us permission to use such content (including your username and profile image) for promotional purposes, while ensuring your content is not misrepresented or shown in a negative manner.

6. Prohibited Content & Conduct

You agree not to post, upload, transmit, or otherwise make available any content that is:

  • Unlawful, harmful, abusive, defamatory, obscene, or offensive

  • False, misleading, or deceptive

  • Infringing on intellectual property or privacy rights

  • Promotional spam, malware, or viruses

Estelle Luxe reserves the right to remove any content and to terminate accounts that violate these Terms without prior notice.

7. Third-Party Links

The Site may contain links to third-party websites for convenience. Estelle Luxe does not endorse or assume responsibility for the content, products, services, or practices of such third-party sites. Accessing such sites is at your own risk.

8. Payments

Payments for products may be made via UPI, credit/debit cards, net banking, wallets, gift cards, or other supported payment methods. Online payments are processed through authorized payment gateways in compliance with RBI guidelines. Estelle Luxe is not responsible for payment gateway failures or unauthorized transactions beyond its control.

Cash on Delivery (COD) may be available for select locations only and may attract additional charges.

9. Shipping & Delivery

Orders are typically delivered within 7–10 working days, subject to product availability, delivery location, and courier partner timelines. Shipping charges, COD fees, or minimum order fees may apply and are subject to change without prior notice.

Risk of loss and title to products pass to you upon delivery. Estelle Luxe shall not be responsible for delays or non-delivery caused by incorrect or incomplete address details provided by you.

10. Cancellations, Returns & Credit Notes

Estelle Luxe reserves the right to cancel any order due to pricing errors, stock unavailability, suspected fraud, or technical issues. Any payment received for canceled orders will be refunded or credited as applicable.

Due to the nature of demi-fine jewellery, refunds are not permitted. Credit notes may be issued only in cases of manufacturing defects, subject to verification. Customers must report defects with an unboxing video within the specified timeframe and must not post disparaging content on social media prior to resolution.

Shipping and COD charges are non-refundable.

11. Disclaimer of Warranties

The Site, its content, and services are provided on an “as is” and “as available” basis. Estelle Luxe makes no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, Estelle Luxe shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data. Our total liability shall not exceed INR 25,000.

13. Indemnification

You agree to indemnify and hold harmless Estelle Luxe from any claims, losses, damages, or expenses arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or relating to the Site, these Terms, or the relationship between you and Astrik Labz (operating as Estelle Luxe) shall be resolved through arbitration in Punjab, India, in accordance with the Arbitration and Conciliation Act, 1996 (as amended).

Arbitration shall be conducted on an individual basis only, and not as part of any class or representative action.

15. Electronic Communications

By using the Site, you consent to receive communications from Estelle Luxe electronically, including emails, SMS, or WhatsApp messages. Such communications satisfy legal requirements for written notice.

16. Amendments & Termination

Estelle Luxe reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Site. Continued use of the Site constitutes acceptance of the revised Terms. We may terminate or restrict access to the Site at any time without notice.

17. Entire Agreement

These Terms constitute the entire agreement between you and Astrik Labz, operating under the brand name Estelle Luxe, regarding your use of the Site and supersede all prior communications or agreements.

If any provision of these Terms is held to be invalid or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Estelle Luxe is a brand owned and operated by Astrik Labz.
